1、I 摘 要 物业管理作为一个新兴的行业，在我国尚处于起步阶段，随着我国房地产的飞速发 展， 商业住宅小区的数量成倍增长， 其发展的速度远远超过了法律规范这一行业的速度， 在其逐步走向成熟的过程中暴露出许多深层次的法律问题。物业管理企业在实际的经营 过程中，会存在很大的风险，如何规避这些风险，是本文研究的立足点。本文以物业管 理中存在的突出法律问题为切入点，站在物业管理企业的角度，去规避在实际经营中出 现的风险，如有些不可避免而且规避不掉的风险，本文要提出突出的问题，并研究出相 应的对策给物业管理企业做为参考。因此，选择“物业管理法律问题研究”这一课题， 并结合鞍山市大德物业管理有限公司的实际情
2、况，对大德物业管理有限公司存在的停车 位问题、 共有部分问题、 安保问题和收取各种服务费难的相关的几个突出问题进行分析， 并得出相应的解决问题的对策。 本文分为四个部分：第一部分为物业管理的基本理论概述。包括物业和物业管理的 概念，物业管理的理论依据和法律性质；第二部分介绍了鞍山市大德物业有限公司的基 本情况。包括公司的企业文化、服务范围和工作时间等；第三部分是鞍山市大德物业有 限公司在物业管理中存在的法律问题。这部分提出了四个突出问题；第四部分是针对第 三部分提出的问题总结出相应的解决问题的对策。 关键词：物业管理；物业公司；安保问题 II Abstract Property managem
